ECJ interprets creditors’ pre-contract obligations under Articles 5(6) and 8(1) of CCD (ECJ)

The European Court of Justice (ECJ) has published a preliminary ruling regarding the relationship between different pre-contractual obligations on the creditor under Article 5(6) of the Consumer Credit Directive (Directive 2008/48/EC) (CCD). In the case of Michel Schyns v Belfius Banque SA Case (C 58/18), the ECJ considered whether certain provisions of Belgian consumer credit law are compatible with these provisions.
