Advocate General Kokott gives opinion on pre-contractual creditor obligations under CCD

The German Advocate General of the Court of Justice of the European Union has given her opinion on the relationship between different pre-contractual obligations on the creditor under the Consumer Credit Directive (Directive 2008/48/EC) (CCD). The points at issue were: the extent of the pre-contractual duty to provide explanations; and the potential importance of the creditworthiness of the consumer for the conclusion of the agreement.
